Agreement to Terms

These Terms of Service ("Terms") govern your use of the SetVita mobile application and website (collectively, the "Service") operated by SetVita ("we," "us," or "our").

By accessing or using SetVita, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Eligibility and Age Requirements

You must be at least 13 years of age to use SetVita. If you are under 18 years of age (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service and agree to these Terms on your behalf.

If you are located in the European Economic Area (EEA), you must be at least 16 years of age to use the Service, or have verifiable parental consent if you are between 13 and 16 years of age, in accordance with GDPR requirements.

By using SetVita, you represent and warrant that you meet these age requirements. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information promptly.

Description of Service

SetVita is a workout tracking application that allows users to:

  • Log and track workouts, exercises, sets, and repetitions
  • Create custom exercises and workout routines
  • View workout history and progress statistics
  • Calculate barbell weights with the plate calculator
  • Share routines with other users
  • Sync data across devices via cloud backup
  • Import and export workout data

User Accounts

Account Creation

To use certain features of SetVita, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Account Termination

You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

User Content

Your Content

You retain ownership of any content you create within SetVita, including custom exercises, workout data, routines, and notes ("User Content"). By using the Service, you grant us a limited license to store, display, and process your User Content solely to provide the Service to you.

Shared Content

When you choose to share a routine with others, you grant a limited license for that content to be viewed and used by the recipients. You are responsible for ensuring you have the right to share any content you distribute.

Prohibited Content

You agree not to create or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on any third party's intellectual property rights
  • Contains viruses or malicious code
  • Impersonates any person or entity
  • Violates any applicable law or regulation

Community Submissions

SetVita may allow users to submit exercises, workout routines, programs, or other fitness-related content for potential inclusion in the app's public library ("Community Submissions"). This section governs such submissions.

License Grant for Community Submissions

By submitting any Community Submission to SetVita, you irrevocably grant to SetVita and its affiliates, successors, and assigns a perpetual, worldwide, royalty-free, fully paid-up, non-exclusive, transferable, and sublicensable license and right to:

  • Use, reproduce, modify, adapt, translate, and create derivative works from your Community Submission
  • Publish, publicly display, publicly perform, and distribute your Community Submission in any media or format now known or hereafter developed
  • Incorporate your Community Submission into SetVita's exercise library, routine database, or any other part of the Service
  • Sublicense the foregoing rights to third parties, including other users of the Service
  • Use your Community Submission for promotional, marketing, and advertising purposes

This license continues even if you stop using the Service or delete your account. You understand that once a Community Submission is incorporated into the app's library, it may not be possible to remove it entirely.

Waiver of Moral Rights

To the fullest extent permitted by applicable law, you irrevocably waive and agree not to assert any "moral rights" or equivalent rights you may have in your Community Submissions, including rights of attribution, integrity, and any right to object to derogatory treatment of your work. You acknowledge that SetVita may modify, edit, or adapt your submissions without attribution or notice to you.

Attribution

SetVita is not obligated to provide attribution or credit for Community Submissions. However, we may, at our sole discretion, choose to credit contributors. Any decision to provide or remove attribution is entirely at SetVita's discretion and may be changed at any time without notice.

Representations and Warranties

By making a Community Submission, you represent and warrant that:

  • You are the original creator of the submission or have obtained all necessary rights, licenses, and permissions from any third parties
  • Your submission does not infringe upon or violate any copyright, trademark, patent, trade secret, or other intellectual property right of any third party
  • Your submission does not contain any false, misleading, or deceptive information
  • Your submission does not promote dangerous exercises or techniques that could cause injury
  • You have the legal right and authority to grant the licenses described in this section
  • Your submission complies with all applicable laws and regulations
  • If your submission includes any third-party content (such as images or descriptions), you have obtained all necessary permissions

No Compensation

You acknowledge and agree that you will not receive any compensation, royalties, or payment of any kind for your Community Submissions, regardless of how they are used. Your submission is entirely voluntary, and the consideration for the license granted is your ability to contribute to the SetVita community and have your content potentially included in the app.

Review and Acceptance

SetVita reserves the right, but has no obligation, to review, approve, reject, modify, or remove any Community Submission at any time and for any reason, without notice or liability to you. Not all submissions will be accepted into the app's library. SetVita may edit submissions for clarity, accuracy, formatting, or any other reason before inclusion.

Indemnification for Submissions

You agree to indemnify, defend, and hold harmless SetVita and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your Community Submissions, including any claim that your submission infringes the intellectual property rights of any third party.

Acceptable Use

You agree to use SetVita only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated means (bots, scrapers) to access the Service
  • Reverse engineer or decompile any part of the Service
  • Use the Service to transmit spam or unsolicited messages
  • Attempt to bypass any security measures

Subscriptions and Payments

Free Features

SetVita provides all core workout tracking features for free, including unlimited routines, custom exercises, and full workout history. Free users will see advertisements.

Optional Subscription

An optional subscription is available to remove advertisements. Subscriptions are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.

Subscription Terms

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions through your App Store or Play Store account settings
  • Refunds are handled according to Apple or Google's refund policies

Intellectual Property

Our Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by SetVita and is protected by copyright, trademark, and other intellectual property laws.

Exercise Library

The exercise library, including exercise names, descriptions, and instructions, is provided for informational purposes. Exercise information is compiled from publicly available sources and common fitness knowledge.

Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to you.

DMCA Copyright Policy

SetVita respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement.

Filing a DMCA Notice

If you believe that content available through SetVita infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to be infringed
  • Identification of the material claimed to be infringing and its location within the Service
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

Designated DMCA Agent

Send DMCA notices to: legal@setvita.app with "DMCA Notice" in the subject line.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification containing: your signature, identification of the removed material, a statement under penalty of perjury that you believe the material was removed by mistake, and your consent to jurisdiction of the federal court in your district.

Repeat Infringers

SetVita will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.

Health Disclaimer

SetVita is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The Service provides tools for tracking workout activities. It does not provide medical advice, fitness advice, or health recommendations. Before starting any exercise program, consult with a qualified healthcare provider.

You acknowledge that:

  • Exercise involves inherent risks of injury
  • You are solely responsible for your physical activities and safety
  • The exercise information provided is general in nature and may not be suitable for your specific situation
  • You should stop exercising and seek medical attention if you experience pain, dizziness, or other symptoms

Pregnancy Disclaimer

Any pregnancy-related information, exercise modifications, or guidance provided within SetVita is for general informational purposes only and is not a substitute for professional medical advice.

If you are pregnant, planning to become pregnant, or have recently given birth, you must consult with your healthcare provider before starting, continuing, or modifying any exercise program. Every pregnancy is different, and what is safe for one person may not be safe for another.

SetVita assumes no responsibility or liability for any decisions you make regarding exercise during pregnancy. You use any pregnancy-related features or information entirely at your own risk. We strongly recommend:

  • Obtaining clearance from your doctor or midwife before exercising during pregnancy
  • Immediately stopping exercise and seeking medical attention if you experience bleeding, dizziness, shortness of breath, chest pain, headache, muscle weakness, calf pain or swelling, uterine contractions, decreased fetal movement, or fluid leaking from the vagina
  • Avoiding exercises that your healthcare provider has advised against
  • Not relying on the app as a substitute for professional prenatal care

Third-Party Services

SetVita may integrate with third-party services including:

  • Google AdMob: For displaying advertisements
  • Firebase: For authentication and data storage

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SETVITA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless SetVita and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Your User Content

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

For users in the European Union, European Economic Area, United Kingdom, or Switzerland: Nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence. You retain the right to bring legal proceedings in the courts of your country of residence, and mandatory local laws will apply to the extent they provide greater protection than Delaware law.

Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Informal Resolution First

Before initiating any arbitration or court proceeding, you agree to first contact us at legal@setvita.app and attempt to resolve the dispute informally for at least 30 days. Most disputes can be resolved this way.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action and Jury Trial Waiver

YOU AND SETVITA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both you and SetVita agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to legal@setvita.app within 30 days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you and SetVita may pursue claims against each other in court.

Exceptions

This arbitration agreement does not apply to: (1) claims that qualify for small claims court; (2) actions to enforce intellectual property rights; or (3) requests for injunctive relief. Additionally, this arbitration agreement does not apply to users in jurisdictions where arbitration agreements are prohibited by law.

Mass Arbitration Procedures

If 25 or more similar arbitration demands are filed against SetVita within a 90-day period, the parties agree to implement a bellwether process: up to 10 cases will be selected for initial arbitration, and the results will inform settlement discussions for remaining cases. This process is designed to resolve disputes efficiently while preserving each claimant's individual rights.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you through the app or via email.

Your continued use of SetVita after any changes indicates your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SetVita regarding your use of the Service and supersede any prior agreements.
